In New Jersey, Driving While Intoxicated (DWI) is against the law. If you are stopped while driving a vehicle under suspicion of drunk driving, the officer may require you to take a field sobriety test and a breathalyzer test. Under the Per Se Law, legal intoxication is established if your blood alcohol level is 0.08% or higher. The field sobriety test relies on the officer’s observations and interpretations of your mental and physical state as well as your level of impairment. New Jersey’s DUI laws also include laws making a DUI drug charge possible.
